Stalking orders are serious. Like restraining orders, Stalking Protective Orders can show up on background checks, have immigration consequences, limit a person’s right to own firearms, and have a number of other collateral consequences. Even more critical, having such an order against you can lead to immediate arrests by police and prosecutions by the District Attorney for contempt of court (with a possible sentence of 6 months in jail and fines). Although some of the scheduling procedures differ between Multnomah and Clackamas County, Oregon law applies to all counties in the State. Is it possible to have a Stalking Protective Order dismissed?

Unlike Family Abuse Restraining Orders, Stalking Protective Orders (SPO) are of indefinite duration. They don’t just expire after a certain period of time. However, it is possible to later have an SPO order dismissed and removed from the law enforcement database. This is common in SPO cases that involve a divorce, where the parties end up living far enough away from each other and other factors exist that persuade a Judge that the stalking order is no longer needed. If you have an order against you, and want to move for it to be dismissed, give Ken a call. Likewise, if you obtained such an order, and the other party is contesting it, call Ken immediately.
